Terms and Conditions for the sale of classic cars via auction

  1. Scope
    These Terms and Conditions (T&C) govern the business relationship between Emil Frey Ltd and the customer for the sale of classic cars. The precise vehicle details – including model, year of manufacture, chassis number, body, colour and condition – are specified in the sales contract.

  2. Prices and payment conditions
    2.1. The prices for the classic vehicles are set by the highest bid made in the auction in accordance with the vehicle description, provided the minimum price is reached or exceeded, and may vary by condition and rarity.
    2.2. Emil Frey Ltd reserves the right, should be minimum price not have been reached, to hold follow-up negotiations on the offered price by agreement with the customer.
    2.3. A commission of 10% of the hammer price is payable by the buyer on each vehicle purchased at auction.
    2.4. The vehicle purchase price is paid in accordance with the agreements in the sales contract. The vehicle remains the property of Emil Frey Ltd until the payment has been made in full.

  3. Condition of the vehicles
    3.1. Classic cars are sold in their current condition, as specified in the vehicle description. The customer is aware that classic cars may show signs of wear and use due to age.
    3.2. We accept no warranty or guarantee for the condition or functionality of the vehicles, unless expressly agreed in the sales contract.

  4. Right of revocation and return
    4.1. Returns or exchanges are excluded.

  5. Limitation of liability
    5.1. We accept no liability for direct or indirect damages arising from the purchase, possession or use of the classic cars acquired.

  6. Data protection
    6.1. The provisions of the Data Protection Act and the relevant legal standards will be observed when collecting, processing and using personal data. Detailed information about data protection can be found in the data protection agreement.

  7. Amendments to the T&C
    7.1. We reserve the right to amend these T&C at any time. The amended conditions shall apply to all transactions concluded after the amendments have been made.

  8. Applicable law and legal venue
    8.1. These T&C are subject to Swiss substantive law to the exclusion of UN sales law (CISG). The provisions of the Swiss Civil Procedure Code apply to disputes arising from or in connection with these T&C and the sale of classic cars.
